It is clear that enough Republicans want a floor fight to create a scene. We generally assume that this will be fruitless. What is not well appreciated yet are the variety of ways things could go off the rails on January 6th and how few remedies we have.

At this point, lacking Senate support and without a House majority, there is effectively only one option left – find a way for Mike Pence to go rogue at usurp the process. Two things to keep in mind:

First, the language under which the votes are counted is murky and the 12th amendment and the 1887 Electoral Count Act are in conflict. Pence may try to make the case that it is for him alone to decide which electoral votes to recognize. This would involve either simply stating that he is using his Constitutional prerogative, as he sees it, to count the electoral votes (one assumes to recognize bogus slates) and/or appealing to the SC to adjudicate the constitutionality of the 1887 Act.

Secondly, if the election devolves to the House, it is unclear how the votes of each state delegation are chosen. However, if 126 GOP representatives don’t appear, there will not be a 2/3 quorum as required, the House would be unable to “chuse” and Mike Pence becomes President – “And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in case of the death or other constitutional disability of the President.” – 12th Amendment.

Note that these two approaches to stealing the election are also in conflict so Pence would have to pick one and run with it. Given the rift within the party, Pence is likely hearing both sides of this argument loud and clear. Or, he could surprise us obey the law and allow the votes to be counted correctly. Don’t bet on it.
