WaPo: After Supreme Court dismisses Texas case, Trump says his efforts to challenge election results are ‘not over’

What sort of desperate move will we see on Jan 6th? There is no meaningful legal action that can be pursued in the meantime. If we don’t win both seats in Georgia, I expect them to make the unthinkable move and dispute the Elector’s votes.

If we win, they won’t have the votes in the Senate to sustain a dispute (maybe even if they do win – we just need three to obey the law on that day).

But it isn’t over. Pence can take the 1887 Act to the SC, claiming that it infringes on his authority under the 12th Amendment.

Assuming Biden survives this, it STILL won’t be over. Check back for more details on their moves between January 7th – January 20th. Pence can make the same argument after Jan 6th and claim that Congress usurped his authority. It’s a weak argument, but I expect them to make it.

If the Rs don’t successfully create a meaningful dispute on January 6th that enables them to contend, arguendo, that one side picked Trump and other side Biden it becomes more difficult to request the SC intervene to settle it. But that doesn’t mean it’s impossible or that they won’t try. Stay tuned…
